Shall various Sections of the Balch Springs Home Rule Charter be amended to make corrections in style, form and for typographical errors and clarification, without making any substantive changes in the Charter.

Shall Section 3.01 of the Balch Springs Home Rule Charter be amended to change the term limits for council members from six consecutive years, or three consecutive terms, to twelve years, or six terms, with three consecutive terms being separated by a one year period of nonservice, providing that no council member shall serve more than twelve years, and providing a period of service of less than one year shall not be included in the "six terms" or "twelve years" limitation.

Shall Section 3.10 of the Balch Springs Home Rule Charter be amended to provide that five members of the City Council shall constitute a quorum for the purpose of transaction of business.

Shall Section 10.06 of the Balch Springs Home Rule Charter be amended to provide for notification of the City, by any person having a claim for damages, to be made within six (6) months of the date of the act creating the alleged liability.

Throughout this Charter, words used in expressing masculine gender shall be construed to include the feminine. The word "Council" shall be construed to mean the City Council of the City of Balch Springs."

Shall the Duncanville City Charter be amended to increase the size and composition of the City Council from five (5) Council Members to six (6) Council Members, including one member to be elected at large, and to confer on the Mayor the right to vote, and by providing transitional provisions to take effect following the general election for municipal officers in May, 2003, by amending Section 2.01, Section 2.05, Section 7.03 (second paragraph only), Section 7.04, subsections (1), (3), (4), and (5) of Section 9.02, and subsection (z) of Section 11.02.

PROPOSITION NO. 5

Should Section 7.04(c) of the Duncanville City Charter be amended to conform to state and federal law to remove all descriptions of council member district boundaries, said subsection (c) of Section 7.04 to read in its entirety as follows: Sec. 7.04 NUMBER, SELECTION AND TERM OF COUNCIL
(c) Five (5) Council members shall be elected from single member districts. There shall be five (5) districts and a Council member elected from each district. The five (5) districts shall be defined by ordinance and the boundaries thereof shall be subject to review no less frequently than the year following each federal decennial census based upon population equality to ensure equal voting rights for all citizens under state and federal law. In addition to the qualifications of Section 2.02 each such candidate must reside in their district for no less than six (6) months prior to said election. If a member of the Council elected from a single member district should cease to reside within his elected district, his office shall immediately become vacant.

Except as otherwise provided by this Charter, all powers of the City and the determination of all matters of policy shall be vested in the Council. Without limitation of the foregoing powers of the Council, the Council shall also have the power to:
(12) Appoint a City Attorney who shall be a competent attorney licensed to practice law in the State of Texas and who shall hold office at the pleasure of the City Council.
