PROPOSITION 1

Shall Article II, Section 1, of the DeSoto City Charter be amended to provide and clarify that: (1) a person currently serving as a Councilmember, is, without having to wait one year from the expiration of such person’s previous term of office, eligible to become a candidate for the office of Mayor, and if elected, serve as Mayor for not more than six consecutive years; (2) a person who has served as a Councilmember for six consecutive years shall not be eligible to become a candidate for, or serve in, any place on the City Council, other than as Mayor; and (3) a person who has served six consecutive years as Mayor shall not be eligible to become a candidate for, or serve in, any place on the City Council, including as Mayor, until at least one year has elapsed since the expiration of such person’s previous term of office of Mayor.

Deberá el Artículo II, Sección 1, de los Estatutos de la Ciudad de DeSoto, ser enmendado para prever y clarificar que: (1) una persona que este fungiendo actualmente como miembro del Consejo es, sin tener que esperar un año a partir de la expiración del termino de oficina de dicha persona, elegible para ser un candidato para el cargo de Alcalde, y, si es elegido, fungir como Alcalde por no más de seis años consecutivos; (2) una persona que haya servido como miembro del Consejo por seis años consecutivos no será elegible para ser un candidato para, o fungir en, ningún lugar en el Consejo de la ciudad, que no sea como Alcalde; y (3) una persona que haya fungido por seis años consecutivos como Alcalde no será elegible para ser un candidato para, o fungir en, ningún lugar del Consejo de la ciudad, incluyendo el Alcalde, hasta que haya transcurrido por lo menos un año de haber terminado su cargo en la oficina de Alcalde.

PROPOSITION 2

Shall Article II, Section 2, of the DeSoto City Charter be amended to conform to State law to clarify that when the Mayor and Councilmembers hold three (3) year terms they are subject to the automatic resignation provision in the Texas Constitution when such office holder becomes a candidate for election to a different elected public office at any time when their unexpired term shall exceed one (1) year.

PROPOSITION 3

Shall Article II, Section 2, of the DeSoto City Charter be amended to clarify that a City employee or person appointed to a City board or commission who becomes candidate for nomination or election to a publicly elected office forfeits their position with the City upon the election and qualification for such elected office.

PROPOSITION 4

Shall Article II, Section 3, of the DeSoto City Charter be amended to clarify that candidates for election to office of Mayor or Councilmember must satisfy the same qualifications that the Mayor and Councilmembers must satisfy.

Shall Article II, Section 3, of the DeSoto City Charter be amended to conform to State law in regard to members of the City Council holding other public offices.

Shall Article III, Section 5, of the DeSoto City Charter be amended to require the returns of City elections to be conducted in accordance with State law.

Shall Article VII, Section 5, of the DeSoto City Charter be amended to conform to State law to require the City budget to be adopted at least ten (10) days prior to the beginning of each fiscal year.

Shall Article VII, Section 13, of the DeSoto City Charter be amended to require the City to change the certified public accountant conducting an independent audit of the City accounts at least every five (5) years.

Shall Article X, Section 3, of the DeSoto City Charter be amended to require the Planning and Zoning Commission to conduct a comprehensive review of the Master Plan at least every ten (10) years and recommend appropriate amendments to the City Council.
